Terms of Service

These Terms of Service ("Terms") govern your use of the Parkd mobile application and the website at parkdllc.com (together, the "Service"), operated by PARKD LLC ("Parkd," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Parkd marketplace

Parkd is a peer-to-peer marketplace that connects people looking for parking ("drivers") with people who list parking spaces ("hosts"). Parkd provides the platform; the parking spaces themselves are offered by hosts, not by Parkd. We are not a party to the agreement between a driver and a host for any given booking.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date.

3. Bookings & payments

Drivers pay the price set by the host plus any applicable service fees, shown before you confirm a booking. Payments are processed by our third-party payment provider. Hosts receive payouts for completed bookings, less applicable fees. You authorize Parkd and its payment provider to charge your selected payment method for amounts you incur.

You agree not to misuse the Service, including by providing false information, infringing others' rights, attempting to circumvent payments, harassing other users, or using the Service for any unlawful purpose.

7. Disclaimers

The Service is provided "as is" and "as available." Parkd does not guarantee the condition, safety, legality, or availability of any listed space, or the conduct of any user. To the fullest extent permitted by law, we disclaim all warranties.

8. Limitation of liability

To the fullest extent permitted by law, PARKD LLC will not be liable for any indirect, incidental, or consequential damages arising out of your use of the Service. Disputes about parking, damage, or conduct are primarily between drivers and hosts.

9. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms or to protect the community. You may stop using the Service and request account deletion at any time.

10. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use of the Service after changes means you accept the updated Terms.
